Booking details: name, email, phone number, WhatsApp/WeChat ID, billing address, check-in/check-out dates, number of guests, and special requests.
Identity verification: government-issued photo ID may be requested prior to check-in for security and damage-deposit purposes, consistent with standard short-term rental industry practice.
Payment information: processed by third-party payment gateways and platforms (e.g. Airbnb, Booking.com, Stripe). We do not store full credit card numbers on our own systems.
Communications: messages sent via our website enquiry form, WhatsApp, WeChat, email, or phone, including the content of those messages.
Website usage data: IP address, browser type, pages viewed, and cookies (see our Cookie Policy).
Property security footage: some properties may have external CCTV or a video doorbell covering entry points only (never bedrooms, bathrooms, or interior living spaces). This is disclosed in the individual property listing.

To comply with legal, tax, and regulatory obligations, including local council short-term letting requirements;
To investigate and prevent fraud, property damage, unauthorised events/parties, or breaches of our house rules;

3. Disclosure to Third Parties
We may disclose personal information to:
Booking and distribution platforms — Airbnb, Booking.com, Expedia, Tripadvisor, Stayz — where a booking is made or listed through that channel;
Service providers — cleaning contractors, maintenance staff, and property managers, strictly to the extent needed to prepare for and service your stay;
Payment processors engaged to process bookings and security deposits;
Messaging platforms — WhatsApp (Meta) and WeChat (Tencent) — if you choose to contact us through those channels. Messages sent via WeChat may be processed on servers located outside Australia, including in China. By messaging us on WeChat, you acknowledge this overseas storage;
Government and regulatory bodies, where required by law (e.g. Queensland tourism levy, tax, or law enforcement requests);
Professional advisors such as our accountant or solicitor, where necessary.
We do not sell personal information to third parties.
4. Overseas Disclosure
Where you communicate with us via WeChat, or where a booking platform's servers are located overseas, your personal information may be handled outside Australia. We take reasonable steps to ensure overseas recipients handle your information consistently with the Australian Privacy Principles, but we cannot guarantee the privacy practices of third-party platforms we do not operate, and recommend reviewing WhatsApp's and WeChat's own privacy policies.
5. Data Security & Retention
We take reasonable technical and organisational steps to protect personal information from misuse, loss, and unauthorised access. Booking and guest identification records are retained for as long as reasonably necessary for tax, insurance, and legal purposes (generally up to 7 years, in line with Australian record-keeping requirements), after which they are securely deleted or de-identified.
6. Your Rights
Under the Australian Privacy Principles, you may request access to, or correction of, the personal information we hold about you. You may also request that we cease using your information for direct marketing at any time. To make a request, contact us using the details below. These Booking Terms & Conditions ("Terms") govern all bookings made directly with Omi Holiday (a trading name of Océano Realty Pty Ltd) via our website, WhatsApp, WeChat, email, or phone. By making a booking, the lead guest confirms they have read, understood, and agree to these Terms on behalf of all guests in their party. Where a booking is made via a third-party platform (Airbnb, Booking.com, Expedia, Tripadvisor, Stayz), that platform's own terms also apply and, in the event of a direct conflict specifically regarding payment and cancellation processing, the third-party platform's terms will govern that aspect of the booking.
1. Booking & Payment
A booking is only confirmed once full payment or the required deposit has been received and a booking confirmation has been issued by Omi Holiday.
The lead guest must be at least 18 years of age and will be the party legally responsible for the booking, the conduct of all occupants and visitors, and any loss or damage arising from the stay.
Quoted prices are in Australian Dollars (AUD) and may include a cleaning fee, booking fee, and/or refundable damage bond, itemised at the time of booking.
Omi Holiday reserves the right to correct any pricing errors on the website prior to booking confirmation and to decline a booking made in reliance on an obvious pricing error.
2. Cancellations & Refunds
Unless a different policy is stated on the specific property listing at the time of booking, the following applies to direct bookings:

Cleaning fees and booking fees are non-refundable once a booking is confirmed. Omi Holiday strongly recommends guests obtain their own travel insurance to cover unforeseen cancellations. Refunds, where payable, will be processed to the original payment method within 14 business days.
3. Security / Damage Bond
A refundable security bond may be charged or pre-authorised prior to check-in. This bond covers damage, excessive cleaning, missing items, key/access-device replacement, or breach of these Terms (including occupancy or noise breaches).
The bond, less any deductions reasonably assessed by Omi Holiday, will be released within 7 business days after check-out, following a property inspection.
Where damage or additional costs exceed the bond amount, the guest remains liable for the full cost and authorises Omi Holiday to charge the payment method on file for the difference.
4. Check-In / Check-Out
Standard check-in is from 3:00pm and check-out is by 10:00am, unless otherwise agreed in writing. Late check-out or early check-in, where available, may incur an additional fee. Failure to vacate by the stated check-out time may result in an additional night being charged.
5. Occupancy & House Rules
The maximum number of guests (including children and infants) stated on the property listing must not be exceeded at any time without Omi Holiday's prior written consent.
No parties, functions, or events are permitted at any property under any circumstances, unless the listing explicitly states otherwise and prior written approval is obtained.
Guests must comply with any noise curfew stated for the property (commonly 10:00pm–8:00am) out of respect for neighbours and body corporate by-laws.
Smoking is strictly prohibited inside all properties. Where permitted, outdoor smoking areas will be specified in the listing.
Pets are only permitted where the specific listing states "pet-friendly," and any pet must be declared at the time of booking.
Guests are responsible for locking the property and safeguarding access codes/keys during their stay.
6. Right of Entry
Omi Holiday or its authorised representatives (including cleaners, maintenance contractors, and property managers) may enter the property during a stay, with reasonable notice where practicable, to carry out repairs, respond to an emergency, or investigate a suspected breach of these Terms. In the case of a genuine emergency or reasonable suspicion of a breach (including suspected over-occupancy or an unauthorised event), entry may occur without prior notice.
7. Right to Refuse or Terminate a Stay
Omi Holiday reserves the right to refuse entry, or to terminate a stay without refund, where a guest or occupant:
Exceeds the permitted occupancy or hosts an unauthorised party/event;
Engages in illegal activity, violent, abusive, or threatening behaviour towards staff, contractors, or neighbours;
Causes material damage to the property or poses a safety risk to themselves, other guests, or the property; or
Breaches any material term of these Terms or the specific property's house rules.
In such circumstances, no refund will be provided for the remaining nights of the stay, and the guest remains liable for any resulting loss or damage.
8. Guest Liability & Use of Facilities
Guests use any pool, spa, outdoor area, appliances, or equipment at the property entirely at their own risk. Guests are responsible for the supervision of children and any guests under their care at all times, particularly around pools, balconies, and stairs. Guests are liable for any loss, theft, or damage to the property or its contents caused by themselves, their party, or their visitors during the stay, beyond fair wear and tear.
9. Limitation of Liability
To the maximum extent permitted by law, Omi Holiday and Océano Realty Pty Ltd, and their owners, directors, employees, and contractors, exclude all liability for any indirect, incidental, or consequential loss, and for any injury, loss, or damage arising from a guest's use of the property, except where such liability cannot be excluded under the Australian Consumer Law. Where Omi Holiday's liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the accommodation service or the cost of resupplying it.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on guests under the Australian Consumer Law that cannot lawfully be excluded.
10. Force Majeure
Omi Holiday is not liable for any failure or delay in providing accommodation caused by events beyond its reasonable control, including natural disasters, cyclones, flooding, fire, pandemic, government-imposed restrictions, or utility outages. Where a stay cannot proceed due to such an event, Omi Holiday will offer, at its discretion, a rescheduled stay, credit, or a partial refund reflecting any costs already reasonably incurred.
11. Photography & Marketing
Omi Holiday may photograph properties for marketing purposes. Guest personal photographs are never used without explicit separate consent. Guests must not photograph or publish images of other guests at a property without their consent.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from a booking is subject to the non-exclusive jurisdiction of the courts of Queensland.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
